Lawyers please help! Estate issues?

Deal Score0

My husband passed away recently and he purchased our house before we were married. The deed is in his name only……we had refinanced our mortgage several years go and the bank never pulled the deed to add my name. I discovered all of this after his passing. The executor would not sign the deed over to me and sent me an eviction notice. He wanted to sell the house so he could get paid for his services. After 9 months of harassment and him not signing over the house I moved out and now the house is setting empty. It is in foreclosure and went to a sheriff’s sale and no one placed a bid on the house. My problem is I am liable for the loan and if I continued to pay I get nothing and the estate debt is reduced. The real kicker is the executor is my husband’s brother. Any info. or suggestions I would be very grateful.

as a widow your rights of your husband’s estate and kids if any are according to your state statues. you need a attorney to file suit against the executor for not protecting the assets of the estate, a house empty can not be insuranced. most of the courts will allow money to the widow to live on before any dept is paid have the attorney get a accounting of your husband’s estate of all assets of the estate. was a inventory filed with the probate court? the property was worth refinancing can’t believe the mortgager didn’t bid on it..this executor will have to answer the court
