Can I deduct the remainder of my mortgage point paid?

Hello, I purchased a home in 10/2008 with an 1/8 point paid. I refinanced the house 06/2009. Originally i amortized the point for 30 years. But the loan was paid off when I refinanced. Can I deduct the remainder of the point?
Also do I enter the info for the point under the mortgage broker or the loan holder at the time.
Neither 1098 from the broker or usbank list it. Should I have claimed the whole thing on my 2008 taxes?
I refinanced through the same broker, who then sold the mortgage to the same lender.
when you bought the house the points could have been used at that time
when you refinanced, then you have to amortize over the life of the loan
if you didn’t claim the points in 2008 when you purchased, you could amend that return to include those points
If you refinanced with the same lender, you cannot deduct the points in the year of the refi.
